DSI Renal Holdings, LLC

DSI Renal Holdings, LLC and its affiliated debtors (DSI) filed for Chapter 7 Bankruptcy protection on June 3, 2011. At or around the time of filing, DSI reported minimal assets.

Since the inception of the case, the Trustee filed a lawsuit in the Federal District court in Philadelphia alleging several counts, including fraudulent conveyance and breach of fiduciary duty, resulting from the January 11, 2010 global restructuring of the Debtor and their affiliates, including their operating subsidiary DSI Renal, Inc. The law suit was moved and will be tried by a jury in US District Court in Delaware. All pre-trial matters are being handled by Judge Carry in US Bankruptcy Court in the District of Delaware. The defendants filed a motion to dismiss and arguments were heard on July 30, 2014 before Judge Carey.

On July 20, 2017, Judge Carey issued an order denying the motion to dismiss 5 of the 9 counts brought forth by the Trustee, allowing the lawsuit to proceed. Responses to complaints are expected in August 2017.
